Service Availability

We strive to maintain 99.9% service uptime. However, we do not guarantee uninterrupted service and will not be liable for any compensation should the service become unavailable for any reason.

Account Setup

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under.

3. Payment Terms

All services are billed in advance on a monthly, quarterly, semi-annual, or annual basis. Payment is due at the beginning of each billing cycle.

Refund Policy

We offer a 30-day money-back guarantee on shared hosting services. Domain registrations, SSL certificates, and other add-on services are non-refundable. Refund requests must be submitted through our billing department.

Late Payments

Accounts that are 15 days past due will be suspended. Accounts that are 30 days past due will be terminated and all data will be permanently deleted.

4. Acceptable Use Policy

You agree to use our services only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the internet.

Prohibited Activities

You may not use our services for:

• Illegal activities or content
• Spam or unsolicited email
• Phishing or fraudulent activities
• Distribution of malware or viruses
• Copyright infringement
• Resource abuse that affects other customers
• Adult content that violates our policies

Resource Usage

Shared hosting accounts are subject to resource limitations to ensure fair usage for all customers. Accounts that consistently exceed these limits may be suspended or required to upgrade to a higher plan.

5. Account Security

You are responsible for maintaining the security of your account. You must not share your password with third parties and are responsible for all activities that occur under your account.

Backup Responsibility

While we perform regular backups of our systems, you are solely responsible for maintaining independent backups of your website and data. We are not liable for any data loss.

6. Intellectual Property

You retain all rights to your content. By uploading content to our servers, you grant us a limited license to store, transmit, and display that content as necessary to provide our services.

All HostingSMM trademarks, service marks, graphics, and logos used in connection with our services are trademarks or registered trademarks of HostingSMM.

7. Termination

We reserve the right to suspend or terminate your account at any time for violations of these terms or for any other reason we deem necessary to protect our services, infrastructure, or other customers.

You may cancel your account at any time through our billing panel. No refunds will be provided for partial months of service.

8. Limitation of Liability

To the maximum extent permitted by law, HostingSMM shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use our services
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from our services
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services

9. Indemnification

You agree to indemnify and hold harmless HostingSMM, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of our services, including but not limited to your violation of this agreement.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these terms at any time. We will provide notice of material changes via email or through our website. Continued use of our services after any such changes shall constitute your consent to such changes.

11. Governing Law

These terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.
